RELEASE OF LIABILITY, ASSUMPTION OF RISK & BOOKING AGREEMENT
By submitting a booking request to Joyous Spins 360 Photobooth, I acknowledge that I have read, understand, and agree to the following terms:
1. Assumption of Risk
I understand that participation in the 360 photo booth experience and related activities may involve certain risks, including but not limited to slipping, tripping, falling, loss of balance, accidental contact with other participants or equipment, and minor injuries that may occur during participation. I voluntarily choose to participate and assume responsibility for any risks associated with my participation and the participation of my guests.
2. Release of Liability
To the fullest extent permitted by law, I release and hold harmless Joyous Spins 360 Photobooth, its owners, employees, contractors, representatives, and affiliates from claims, demands, damages, injuries, losses, or expenses arising out of or related to my participation in the photo booth experience, except to the extent caused by conduct that cannot legally be released under applicable law.
3. Guest Responsibility
The person submitting the booking request is responsible for communicating these terms to their guests and for ensuring that guests use the photo booth and equipment responsibly. Participants must follow all instructions provided by Joyous Spins 360 Photobooth and its representatives. Joyous Spins 360 Photobooth reserves the right to refuse or discontinue participation by anyone who is behaving in an unsafe, abusive, disruptive, or inappropriate manner.
4. Children & Minors
A parent or legal guardian is responsible for supervising minors participating in the photo booth experience and assumes responsibility for their participation. Children should not use the platform without appropriate adult supervision.
5. Equipment & Property
I agree not to intentionally damage, misuse, move, tamper with, or interfere with the photo booth, platform, camera, lighting, props, or any other equipment provided by Joyous Spins 360 Photobooth. The booking client may be responsible for repair or replacement costs resulting from intentional, reckless, or negligent damage caused by the client or their guests, to the extent permitted by law.
6. Photo & Video Release
I understand and acknowledge that Joyous Spins 360 Photobooth may capture photographs, videos, GIFs, boomerangs, and/or other digital media during my participation in an event.
I hereby grant Joyous Spins 360 Photobooth permission to photograph and/or record me and irrevocably authorize Joyous Spins 360 Photobooth to use, reproduce, edit, alter, copy, publish, exhibit, display, distribute, and otherwise utilize the resulting photographs, videos, GIFs, boomerangs, and other digital media for any lawful purpose, including promotional, advertising, social media, website, portfolio, and marketing purposes.
I understand that I will not have the right to inspect or approve any finished or edited material in which my likeness appears, and I waive any right to royalties, compensation, or other consideration arising from or related to the use of such media.
I hereby release, hold harmless, and forever discharge Joyous Spins 360 Photobooth, including its owners, employees, contractors, representatives, and affiliates, from any and all claims, demands, causes of action, damages, or liabilities arising from or related to the authorized use of my likeness, image, voice, or participation in the captured media, to the fullest extent permitted by law.
I understand that this release applies to media captured during my participation in the event and that I am providing this authorization voluntarily.
Participation in the Joyous Spins 360 Photobooth experience requires agreement to this Photo & Video Release. If I do not agree to these terms, I understand that I will not be permitted to participate in the 360 photo booth experience, and any media captured of me will not be retained and will be deleted in accordance with Joyous Spins 360 Photobooth's media retention practices.
7. Booking Request & Agreement
Submitting a booking request does not guarantee availability or constitute a finalized booking. A booking is confirmed only after Joyous Spins 360 Photobooth has approved the request and any required deposit, payment, contract, or other booking requirements have been completed. I understand that additional terms, including pricing, cancellation policies, payment requirements, event details, and service terms, may apply to my booking.
8. Acknowledgment
By checking the box below, signing, and submitting this form, I confirm that:
- I have read and understand this Release of Liability, Assumption of Risk & Booking Agreement.
- I voluntarily agree to its terms.
- I understand that I am responsible for my own safety and the safety of minors or guests under my supervision.
- I agree to follow all safety instructions and reasonable directions provided by Joyous Spins 360 Photobooth.
